2. Orders & Contract

By submitting an order, the customer submits an offer to purchase the selected products at the price and under the conditions displayed at checkout. An automated acknowledgement confirming receipt of an order does not by itself constitute acceptance of the order. The sales contract is concluded when we expressly accept the order or dispatch the ordered goods, whichever occurs first. We reserve the right to reject or cancel an order before acceptance where permitted by law, including in cases of product unavailability or an obvious pricing or technical error. If payment has already been collected for an order that is not accepted, the amount paid will be refunded. All prices are stated in Euros (€), including applicable taxes unless clearly indicated otherwise.

3. Statutory Conformity of Goods

Consumers are entitled to the mandatory statutory rights and remedies applicable where goods do not conform to the sales contract. Nothing in these Terms creates any additional commercial guarantee or extends the seller’s obligations beyond those required by applicable law.

Damage, deterioration, or defects caused after delivery by circumstances unrelated to a lack of conformity for which the seller is legally responsible are not covered by statutory conformity remedies. In particular, the following circumstances do not, by themselves, constitute a lack of conformity:

• biting, chewing, scratching, tearing, or other damage caused by an animal;
• normal wear and tear resulting from ordinary use;
• cosmetic scuffs, fading, surface wear, tire wear, or comparable deterioration resulting from use;
• improper use, handling, storage, maintenance, or cleaning;
• accidents, neglect, misuse, or other external causes occurring after delivery;
• incorrect assembly where the cause is not attributable to inadequate instructions for which the seller is responsible;
• failure to follow supplied instructions or safety guidance; or
• use exceeding stated weight, size, load, or other product limitations.

Where a customer asserts a lack of conformity, the claim will be assessed in accordance with applicable consumer law, taking into account the nature of the product, the alleged defect, the circumstances of use, and any applicable statutory rules concerning the burden of proof. We may request information reasonably necessary to assess the claim, including photographs, video, a description of the issue, proof of purchase, and, where reasonably necessary, return or inspection of the product. These requirements do not limit any mandatory consumer rights.

4. Right of Withdrawal

Consumers have the statutory right to withdraw from an eligible distance sales contract within 14 days without giving a reason, subject to the conditions and exceptions provided by applicable law. For goods, the withdrawal period generally begins on the day on which the consumer, or a third party designated by the consumer other than the carrier, acquires physical possession of the goods.

The consumer must communicate the decision to withdraw within the applicable withdrawal period and return the goods without undue delay and no later than 14 days after communicating the withdrawal. Unless otherwise required by law or expressly agreed by us, the consumer bears the direct cost of returning the goods.

The consumer may inspect and handle the goods only to the extent necessary to establish their nature, characteristics, and functioning. The consumer may be liable for any diminished value resulting from handling beyond what is necessary for that purpose, in accordance with applicable law.

Where the right of withdrawal applies, refunds will be processed in accordance with applicable law. We may withhold reimbursement until we have received the returned goods or the consumer has provided evidence of having sent them back, whichever occurs first, where permitted by law. Supplementary delivery costs resulting from the consumer choosing a delivery method more expensive than the least expensive standard delivery offered by us are not refundable. 5. Product Information & Use

Customers are responsible for selecting a product suitable for their intended use and for observing the product descriptions, dimensions, weight or load limits, assembly instructions, care instructions, and safety information provided with or in relation to the product. Product images are illustrative and minor differences in colour or appearance may occur due to display settings, production variations, or other factors, provided that such differences do not constitute a lack of conformity under applicable law.

6. Limitation of Liability

To the maximum extent permitted by applicable law, DS CONCEPT s.p. is not responsible for loss or damage resulting from misuse of a product, failure to follow instructions or safety guidance, use outside the stated product specifications or limitations, normal wear and tear, or damage caused by animals or other external causes after delivery. Nothing in these Terms excludes or limits liability or consumer rights where such exclusion or limitation is prohibited by applicable law.

7. Applicable Law & Dispute Resolution

These Terms are governed by the laws of the Republic of Slovenia. Where the customer is a consumer, this choice of law does not deprive the consumer of any mandatory protection afforded by the law that would otherwise apply under applicable European Union rules.
